Consumer Credit File Rights Under State and Federal Law
Disputing inaccurate information
You may dispute inaccurate information in your credit report by contacting the credit bureau directly. Neither you nor any credit-repair organization has the right to have accurate, current, and verifiable information removed from your credit report. Credit bureaus remove accurate negative information only when the law requires (generally seven years; bankruptcies may be reported for up to ten years).
Obtaining your credit report
You have a right to obtain a copy of your credit report from a credit bureau and may be charged a reasonable fee. There is no fee if you have been turned down for credit, employment, insurance, or housing within the past 60 days due to information in your report. You are also entitled to a free report if you are unemployed and intend to seek employment within 60 days, receive public assistance, or believe your report contains inaccurate information due to fraud.
Protection from deceptive practices
You have a right to sue a credit-repair organization that violates the Credit Repair Organizations Act. This law prohibits deceptive practices by credit-repair companies.
Right to cancel
You have the right to cancel your contract with any credit-repair organization for any reason within three (3) business days from the date you signed it.
Disputing errors with credit bureaus
You may notify a credit bureau in writing that you dispute the accuracy of information in your credit file. The bureau must reinvestigate and modify or remove inaccurate or incomplete information, and may not charge a fee for this service. If the reinvestigation does not resolve the dispute to your satisfaction, you may submit a brief statement explaining why you believe the record is inaccurate, and the bureau must include a summary of your statement with any report it issues.
Federal oversight: For more information, contact the Federal Trade Commission, Public Reference Branch, Washington, D.C. 20580.
